Garantir a proteção dos animais foi um dos assuntos que mobilizou o Senado em 2019. Dois projetos de defesa dos animais foram aprovados e enviados para análise dos deputados. O PLC 27/2018 que determina que os animais não poderão mais ser considerados objetos, e o PLC 17/2017 que proíbe a eliminação de cães, gatos e aves saudáveis pelos órgãos de controle de zoonoses.
Em 2020 essa mobilização deve continuar. O Senado vai analisar o Projeto de Lei 1.095/2019 que aumenta a pena para maus-tratos de cães e gatos. O texto foi aprovado pela Câmara na última semana de trabalho do Congresso.
O PL 1.095/2019 do deputado Fred Costa (Patriota-MG) aumenta a pena para quem abusa, fere ou mutila cães e gatos. A pena atual, de detenção de três meses a um ano e multa, aumentará para pena de reclusão de dois a cinco anos e multa. O texto prevê ainda a proibição de guarda do animal. A punição atual, prevista na Lei de Crimes Ambientais (Lei 9.605, de 1998), é aplicada para casos de violência contra animais silvestres, domésticos ou domesticados, nativos ou exóticos. A mudança será apenas para cães e gatos.
O deputado declarou que a crueldade, abandono e maus tratos a animais são considerados pela legislação vigente como crimes de menor potencial ofensivo.
“Os animais não possuem meios de se defender, não são capazes de procurar os seus direitos. A única maneira para que tais crimes sejam evitados é o empenho da sociedade, que não deve aceitar tamanha barbaridade, exigindo que as regras que visam reprimir esses crimes sejam cada vez mais rigorosas”, disse o deputado ao apresentar o projeto.
O PLC 27/2018, do deputado Ricardo Izar (PP-SP), estabelece que os animais passam a ter natureza jurídica sui generis, como sujeitos de direitos despersonificados. Eles serão reconhecidos como seres sencientes, ou seja, dotados de natureza biológica e emocional e passíveis de sofrimento.
O texto também acrescenta dispositivo à Lei dos Crimes Ambientais para determinar que os animais não sejam mais considerados bens móveis para fins do Código Civil (Lei 10.402, de 2002). Com as mudanças na legislação, os animais ganham mais uma defesa jurídica em caso de maus tratos, já que não mais serão considerados coisas, mas seres passíveis de sentir dor ou sofrimento emocional.
O senador Randolfe Rodrigues (Rede-AP), relator do projeto na Comissão de Meio Ambiente (CMA), destacou que a nova lei contribuirá para elevar a compreensão da legislação brasileira sobre o tratamento de outros seres.
— É um avanço civilizacional. A legislação só estará reconhecendo o que todos já sabem: que os animais que temos em casa sentem dor e emoções. Um animal deixa de ser tratado como uma caneta ou um copo e passa a ser tratado como ser senciente — destacou o senador na sessão plenária em que o projeto foi aprovado, em agosto passado.
Já o Projeto de Lei da Câmara (PLC) 17/2017 proíbe a eliminação de animais saudáveis pelos órgãos de controle de zoonoses e tem a intenção de incentivar a adoção de cães, gatos e aves saudáveis por meio de convênios do setor público com entidades de proteção animal e outras organizações não-governamentais. A eutanásia só é permitida nos casos de males, doenças graves ou enfermidades infectocontagiosas incuráveis que coloquem em risco a saúde humana e a de outros animais. A proposta também é do deputado Ricardo Izar.
Os dois projetos já haviam sido aprovados pela Câmara, mas como foram modificados pelos senadores, voltam para análise dos deputados, que poderão optar pelo texto do Senado ou pela versão original, da primeira votação na Câmara.

O Projeto de Lei 5441/19 veda a realização, fora da rede do Sistema Único de Saúde (SUS), de consultas ou exames médicos gratuitos ou a doação de medicamento, órtese ou prótese de forma a beneficiar candidato, partido ou coligação durante as eleições. O texto altera a Lei das Eleições e está em tramitação na Câmara dos Deputados.
“A ideia é evitar a utilização imprópria de programas assistenciais por intermédio de investidas oportunistas que, muitas vezes, visam à obtenção de vantagens à custa de situações de miséria humana”, disse o autor, deputado Paulo Bengtson (PTB-PA).
O texto insere dispositivos no trecho da legislação eleitoral que trata das condutas vedadas aos agentes públicos em campanhas eleitorais. Essa norma já equipara à condição de agente público qualquer pessoa que esteja a serviço da administração pública, seja servidor concursado ou não.
Tramitação
O projeto será analisado pela Comissão de Constituição e Justiça e de Cidadania. Depois seguirá para o Plenário.
